Terms of Service

These Terms cover the Emese Care app and the people who use it. If you are an organisation buying Emese Care for your employees or members, your relationship with us is governed by a separate written agreement, not by these Terms.
1. Acceptance of Terms
By creating an account and using the Emese Care application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not create an account or use the App.
These Terms constitute a binding legal agreement between you and Nekotin Kft. ("we", "us", or "our"), the operator of Emese Care.
2. Description of the Service
Emese Care is a digital behaviour-change support platform. It is designed for habits such as nicotine use, social media overuse, alcohol use, gambling, medication dependency, pornography use and drug use.
Not every programme is open yet. At the moment you can start the nicotine programme. The others are in preparation, they are named here because that is the direction of the product, and none of them is something you can sign up for today. We will not charge you for, or promise you, a programme that is not open.
The App provides:
- Personalised content based on your stage of change
- Progress tracking and daily check-ins
- Motivational tools and educational materials
- A structured program tailored to your chosen habit area
- A moderated community where you can share your experience with other users
Emese Care is a support tool. It is not a medical service, therapy, or clinical treatment. See Section 10 (Medical Disclaimer) for full details.
3. Eligibility
You must be at least 18 years old to use Emese Care. By creating an account, you confirm that you are 18 or older.
We do not knowingly collect data from anyone under 18. If we discover that a user is under 18, we will delete their account and all associated data immediately.
This requirement is especially important for users of the Gambling program, where 18+ is a legal requirement in Hungary and across the EU.
4. Your Account
4.1 Registration
You must provide accurate information when registering. You are responsible for keeping your account credentials secure. Do not share your password with anyone.
4.2 One account per person
Accounts are personal. You may not create accounts on behalf of others or create multiple accounts for the same person.
4.3 Account security
If you believe your account has been compromised, contact us immediately at hello@emese.care.
5. Privacy and Data Protection
Your privacy matters deeply to us. We process your personal data under the General Data Protection Regulation (GDPR) and applicable Hungarian law.

Key points:
- Your health-related data is pseudonymised; it is never stored alongside your real identity
- You can export all your data at any time
- You can permanently delete your account and all data at any time
- We will never sell your personal data
6. User Conduct
You agree not to:
- Provide false information during registration or use
- Attempt to bypass the 18+ age gate
- Use the App for any unlawful purpose
- Attempt to access other users' accounts or data
- Attempt to reverse-engineer, scrape, or otherwise extract data from the App
- Misuse the feedback or reporting features
We reserve the right to suspend or terminate accounts that violate these Terms.
Additional rules apply to anything you post where other users can see it. See Section 7 (Community and User-Generated Content).
7. Community and User-Generated Content
7.1 What this section covers
Parts of the App let you post content that other users can see. This includes the Community feed, replies to other people's posts, any photo you attach to a post, any coping strategy you choose to share with the community rather than keep private, and the display name you choose. We call all of it user content, and this section applies to every part of it.
7.2 Zero tolerance for objectionable content and abusive users
We have zero tolerance for objectionable content and for abusive behaviour towards other users. Emese Care is used by people at a vulnerable point in their lives, and a hostile community does real harm. There is no warning system for serious violations: we remove the content, and we may remove the account permanently.
You must not post, share, or send:
- Harassment, bullying, intimidation, or threats of any kind
- Hate speech, or content that attacks or demeans people on the basis of race, ethnicity, national origin, religion, disability, illness, age, sex, gender identity, or sexual orientation
- Sexually explicit or pornographic material
- Graphic violence or deliberately shocking imagery
- Content that encourages, glorifies, instructs, or provides methods for suicide, self-harm, or disordered eating
- Content that encourages another user to relapse, or that mocks, shames, or belittles someone for relapsing
- Promotion, advertising, or sale of nicotine, alcohol, drugs, gambling, medication, or any other addictive product or service
- Another person's private information, including real names, addresses, phone numbers, or photographs shared without their consent
- Impersonation of another person, of a healthcare professional, or of Emese Care staff
- Spam, advertising, referral links, or repeated unsolicited messages
- Anything unlawful under Hungarian or EU law, or anything that infringes someone else's rights
7.3 Automated moderation before publication
Every post, reply, shared coping strategy, photo and display name is checked automatically before it becomes visible to anyone else. The check is performed by an automated system operated on our behalf by Google (the Gemini API), which reads the content and returns a decision to us. Content that fails the check is never published. Automated moderation is not perfect in either direction, which is exactly why the tools in 7.4, 7.5 and 7.7 exist.
We may also restrict the visibility of content, suspend an account, or end it, after publication, on the same grounds set out in 7.2.
7.4 Reporting objectionable content
Every post and every reply in the App carries a Report action. Reporting sends the content to us for review and removes it from your own feed straight away. You do not need to explain yourself, and the author is never told who reported them.
7.5 Blocking abusive users
Every post and every reply also carries a Block action. Blocking someone removes all of their posts and replies from your feed instantly and prevents their content reaching you in future. Blocking also notifies our team, so a user who is blocked repeatedly gets reviewed even when nobody files a report.
7.6 What we do about it
We review reported content and blocked accounts and aim to act within 24 hours. Where we confirm a violation we remove the content and, depending on severity, warn, suspend, or permanently terminate the account. Serious violations, including threats and anything that endangers a person's safety, result in immediate permanent termination without prior notice and without refund. Where the law requires it, we will report content to the competent authorities.
7.7 If we act against your content or your account, and how to appeal
We tell you. If we remove or hide something you posted, refuse to publish it, or restrict or end your account, we will tell you what we did, which rule in 7.2 it was based on, and whether the decision came from the automated check or from a person.
You can challenge it. Write to hello@emese.care within six months of being told. A person who was not involved in the original decision reviews it, we aim to answer within 14 days, and if we got it wrong we restore the content or the account and say so. Using this route is free, and you may say as much or as little as you like.
You are not limited to us. Nothing here stops you taking the matter to a certified out-of-court dispute settlement body under Article 21 of the EU Digital Services Act, or to a court. If a certified body is designated in Hungary for disputes like yours, we will engage with it in good faith.
These rules are how we meet our obligations as a hosting service under the Digital Services Act. They apply to the App's community; they do not apply to a decision to end your account for non-payment or at your own request.
7.8 Other users are not professionals
Content posted by other users is theirs, not ours. It is not checked for medical accuracy, it is not advice from Emese Care, and it must never be treated as a substitute for professional care. See Section 10 (Medical Disclaimer).
7.9 You are responsible for what you post
You are solely responsible for the user content you post and for the consequences of posting it. Do not post anything you would not want associated with you, and remember that the other people in the community are working through the same difficulties you are.
8. Content Ownership
8.1 Your content is yours
Any content you submit to the App (such as your Future Self Letter) belongs to you. You retain full ownership.
8.2 Licence to us
By submitting content, you grant us a limited, non-exclusive licence to store and display that content solely to provide the service to you. Where you post user content to the Community, that licence extends to showing it to other users of the App. We will never sell or commercially exploit your content.
8.3 Your right to delete
You may delete your content and your account at any time, from the app settings or from emese.care/delete-account. Deletion is permanent and completes within 30 days. Two things survive it, and neither identifies you: a hashed record proving the erasure happened, which we keep because the law requires us to be able to demonstrate it, and statistics that were aggregated across many people before you asked. Section 5 of the Privacy Policy sets out the detail, including how long a backup can still contain your data.
9. Intellectual Property
All content, designs, code, and materials in the App, other than content you submit, are the intellectual property of Nekotin Kft. or our licensors. You may not copy, reproduce, or distribute them without our written permission.
10. Medical Disclaimer
Please read this section carefully.
10.1 Not a medical service
Emese Care is NOT a medical service. The App, its content, tools, and programs are for informational and personal support purposes only. Nothing in the App constitutes medical advice, diagnosis, treatment, or therapy.
Emese Care does not replace:
- A doctor, psychiatrist, or psychologist
- An addiction specialist or therapist
- A rehabilitation programme
- Any other professional healthcare service
10.2 Not for emergencies
Emese Care is NOT equipped to handle medical emergencies or mental health crises. The App does not provide real-time crisis support.
If you or someone else is in immediate danger, stop using the App and:

10.3 Withdrawal and medical risk
Some habits, including alcohol, benzodiazepines, and opioids, can cause medically serious withdrawal symptoms. If you are considering stopping use of any substance, speak to a doctor first. Sudden cessation of certain substances can be life-threatening without medical supervision.
Emese Care does not provide personalised medical guidance on withdrawal. Always consult a qualified healthcare professional before making changes to your substance use.
10.4 No guarantees
Emese Care cannot guarantee any outcome. Recovery is a personal journey and results vary significantly between individuals. The App provides tools and support, but your outcomes depend on many factors outside our control.
10.5 Consult a professional
If you have any concerns about your physical or mental health, consult a qualified healthcare provider. Do not delay seeking professional help because of anything you read or experience in the App.
11. Limitation of Liability
To the fullest extent permitted by Hungarian and EU law:
- We provide the App "as is", without warranties of any kind
- We are not liable for any indirect, incidental, or consequential loss arising from your use of the App
- We are not liable for user content posted by other users, beyond the moderation obligations described in Section 7
- Our total liability to you for any claim arising from these Terms shall not exceed the amount you have paid us in the 12 months preceding the claim (or €100 if you have paid nothing)
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded by law. If you are a consumer, your mandatory statutory rights come first: where Hungarian or EU consumer law gives you a right that the limitations above would cut down, the law wins and the limitation does not apply to you.
12. Termination
12.1 By you
You may close your account at any time through the App settings. We delete your data as set out in Section 8.3.
12.2 By us
We may suspend or terminate your account if you violate these Terms, or if we discontinue the service. We will give you reasonable notice where possible. Where the violation involves objectionable content or abuse of another user, Section 7.6 applies and we may terminate immediately without notice.
12.3 Effect of termination
On termination, your right to use the App ends immediately. We will delete your data in accordance with our Privacy Policy.
13. Changes to the Service and These Terms
We may update these Terms from time to time. When we make material changes, we will notify you in the App and update the "Last updated" date above. Your continued use after notification constitutes acceptance of the updated Terms.
If you do not accept the changes, you may close your account before they take effect.

14. Governing Law and Disputes
These Terms are governed by the laws of Hungary and applicable EU law. If you are a consumer resident in another EU country, this choice of law does not deprive you of the protection of the mandatory consumer rules of your own country.
Any dispute will first be addressed through good-faith communication. Write to hello@emese.care and we will answer.
If that does not resolve it, as a consumer in Hungary you may turn to:
- your regional Conciliation Body (Békéltető Testület), a free procedure. Ours is the Pest County Conciliation Body, the body for the county of our registered seat, and you may equally use the one for the county where you live
- the consumer protection authority of the competent government office (kormányhivatal), or the Hungarian Competition Authority (GVH) for unfair commercial practices
- the competent Hungarian court
The European Commission's Online Dispute Resolution platform, which earlier versions of these Terms pointed to, closed on 20 July 2025 and is no longer a route to anything.
Complaints about a moderation decision have their own, faster route: see Section 7.7.
